Moving to Croatia with Croatian Ancestry: The Article 79a Residence Permit

Temporary residence for Croatian emigrants, descendants and their families: the Ministry certificate, application documents, work rights and the route towards permanent residence.

You do not necessarily need to obtain Croatian citizenship before moving to Croatia. For qualifying third-country nationals with a Croatian emigrant connection, Article 79a of the Aliens Act provides a specific temporary residence route. The important first step is to establish eligibility for the Ministry certificate, rather than assume that Croatian ancestry alone creates a right to stay.

Quick answer

Qualifying Croatian emigrants, descendants and family members can seek temporary residence for the immigration and return of the Croatian diaspora. Approval can be granted for up to two years, with the possibility of renewal. Applicants are exempt from attaching proof of financial means and health insurance. Once residence is approved, they can work and be self-employed without a separate stay-and-work permit. The Ministry certificate supports the application; it is not itself residence approval or Croatian citizenship.

What to establish before moving
  • Whether you qualify as an emigrant, descendant, family member or eligible programme beneficiary.
  • Which documents are needed for the Ministry certificate and which are needed for the residence application.
  • How lawful entry, short-stay registration and filing will be coordinated.
  • How work, family applications and any separate citizenship case fit into the plan.

Who can apply for a Croatian ancestry residence permit?

The statutory purpose is temporary stay for the immigration and return of the Croatian diaspora, known in Croatian as privremeni boravak u svrhu useljavanja i povratka hrvatskog iseljeništva. It is set out in Article 79a, written as Article 79.a in the Croatian legislation.

The route covers a Croatian emigrant, a descendant of a Croatian emigrant, a family member of the emigrant or a family member of the descendant, provided that the relevant status is supported by the required Ministry certificate.

It also covers eligible beneficiaries in Croatia of measures, programmes and projects, subject to Ministry certification. Participation in an unrelated course or private programme should not be assumed to satisfy that category.

This is a route for third-country nationals. Someone who already holds Croatian citizenship does not need a foreigner’s residence permit to live in Croatia. EU, EEA and Swiss citizens should have their position assessed under the applicable separate residence regime.

A Croatian ancestor is a starting point, not an automatic approval. The certificate rules refer to citizenship legislation for the definitions of an emigrant and descendant. The relevant ancestor and migration history therefore still need examination. See our Article 11 guide for the citizenship-law emigrant framework.

What is the Ministry certificate?

Two different authorities have different roles. The Ministry of Demography and Immigration issues the certificate supporting the diaspora basis. The Ministry of the Interior, through the competent police administration or station, decides on temporary residence.

Obtaining the certificate does not complete the residence procedure. The application must still meet the remaining immigration conditions.

Documents for the certificate

For an emigrant or descendant, the certificate checklist includes:

  • a valid travel document;
  • proof of registered short-term stay in Croatia;
  • a birth-register extract;
  • a biography;
  • evidence of Croatian belonging, including relevant ancestral records and a family tree; and
  • a recommendation from a Croatian diplomatic or consular mission, or an association or institution of a Croatian community abroad.

The certificate request can be submitted electronically or by post. Its supporting documents must be translated into Croatian. Family members, minors and programme beneficiaries have specific documentation rules rather than an identical adult-descendant checklist.

The short-stay registration requirement affects the sequence. Because the certificate checklist includes registered short-term stay in Croatia, applicants still abroad should clarify entry, registration and certificate arrangements before fixing their relocation timetable. Do not assume that every stage can be completed abroad before arrival.

What documents are needed for the residence application?

The residence file is separate from the certificate request. Its core documents include the temporary residence application on Form 1a, a valid travel document, the required photograph, the Ministry certificate and criminal-record evidence for a first residence application, unless a relevant exception applies.

The criminal-record requirement concerns the home country or a country in which the applicant resided for more than one year immediately before coming to Croatia. Check the competent issuing authority and document formalities for the individual case.

The intended Croatian address and documents supporting accommodation or address registration also need to be coordinated. Do not confuse documents required to issue the certificate with the formalities needed to register residence and obtain the biometric card.

Foreign documents and additional requirements

Check originals, certified copies, Croatian translations and any Apostille or legalisation requirement for each foreign document. Permission to use a copy at the certificate stage should not be treated as a blanket exemption from the police authority’s documentary requirements.

Visa-required applicants must also check the applicable health-status and vaccination documentation. The residence rules introduced in 2026 require Form 18a, no more than 90 days old, for a first temporary residence application by a person subject to the visa regime. This is a separate issue from proof of health insurance.

Do you need proof of income or health insurance?

Article 79a expressly exempts eligible applicants from attaching proof of sufficient financial means and proof of health insurance to the temporary residence application.

The digital nomad income threshold and the ordinary financial calculations for other residence categories should therefore not be imported into an Article 79a application.

The insurance exemption has a specific scope

Not having to attach insurance evidence is not the same as having no healthcare obligations or receiving free medical treatment. After approval, the person’s health-insurance position must be addressed under the applicable Croatian rules, including any required contact with HZZO, the Croatian Health Insurance Fund.

No income evidence does not mean no relocation costs. Housing, living expenses, document preparation and the applicable healthcare arrangements still need a practical budget.

Can you work or start a business in Croatia?

Once temporary residence under Article 79a has been approved, the holder has the right to employment and self-employment without a separate stay-and-work permit or work registration certificate.

This can support employment with a Croatian employer or self-employment, rather than limiting the holder to remote work for a foreign business.

Business registration, taxes, social contributions and any professional licensing requirements remain separate matters. Permission to work does not automatically authorise practice of a regulated profession.

When do these work rights begin?

Do not treat a pending certificate request, the certificate itself or a pending first residence application as equivalent to approved Article 79a status. Work before approval requires a separate lawful basis.

Education and study

The provision also recognises access to educational programmes, vocational training, education and study. Admission criteria and any funding or scholarship conditions still have to be checked separately.

Can your spouse, partner or children use this route?

The certificate framework expressly includes spouses, qualifying unmarried partners, life partners, informal life partners and minor children as family members. A qualifying family member need not establish a separate emigrant ancestor of their own simply to rely on the family-member category.

The relationship must be documented and each person’s status addressed separately. One person’s certificate or residence card does not automatically give residence to the whole family.

An adult child should not automatically be treated as a minor dependant. Their possible eligibility as a descendant, or under another residence basis, needs its own assessment.

Do not automatically use an ordinary family-reunification checklist

Residence granted directly under Article 79a is not the same category as ordinary family reunification. Establish which route is actually being requested before applying its financial requirements and work rules to a spouse or child.

For a minor, check signatures, parental consent and any custody or guardianship documents. The certificate procedure contains specific requirements where a parent or guardian is absent.

Where do you apply, and can you stay while waiting?

The general residence framework provides for applications through Croatian diplomatic or consular offices. Eligible applicants can also apply at the competent police administration or station in Croatia.

Importantly, Article 79a is one of the grounds on which a person who requires a short-stay visa may nevertheless submit the residence application in Croatia during lawful stay. That exception does not waive entry requirements or authorise an overstay.

A certificate request is not a residence application

Where an eligible applicant files the residence application with the police before lawful short-term stay expires, the statutory framework permits remaining in Croatia until the decision becomes enforceable. Merely requesting the Ministry certificate does not trigger that residence-application protection.

Track the immigration deadline independently of the certificate process. Waiting for ancestry records, a certificate or a citizenship decision should not be assumed to extend a visitor’s permitted stay. Travel and re-entry while an application is pending also need separate checking.

How long does residence last, and can it lead to permanent residence?

Temporary residence for this purpose can be approved for up to two years, with the possibility of renewal. The actual approved period must be checked against the individual decision and the validity of the supporting documents.

A renewal application should be filed no later than 60 days before the current temporary residence expires. Approval is not renewed automatically because a certificate was issued on an earlier occasion.

Permanent residence after three qualifying years

The Aliens Act provides a permanent-residence route after three continuous years of approved temporary residence for the immigration and return of the Croatian diaspora immediately before the application, supported by the required Ministry certificate.

This is a separate application, not automatic conversion of a two-year permit. Continuity, permitted absences, current residence status and the other applicable conditions must be assessed.

Qualifying periods under the earlier humanitarian residence route, supported by the relevant diaspora certificate, can also count under the transitional rules. This does not mean that every earlier humanitarian or temporary residence period counts in the same way.

Plan absences before extended trips abroad

A valid card alone is not enough to preserve every residence right. Absences can affect the current temporary residence and the continuity needed for permanent residence. Those are separate checks, so a future permanent-residence allowance should not be treated as permission to ignore the current permit’s absence limits.

Does Article 79a give you Croatian citizenship?

No. Temporary residence, permanent residence and citizenship are different legal statuses. Neither the Ministry certificate nor an Article 79a residence approval is a Croatian passport or a citizenship grant.

The certificate also does not predetermine the assessment of belonging to the Croatian people in a citizenship procedure. Shared family evidence does not make the residence and citizenship decisions interchangeable.

A person planning both relocation and citizenship should therefore coordinate two separate matters. Depending on the facts, the citizenship analysis may concern Article 11 for emigrants and descendants , Article 16 and belonging to the Croatian people , or citizenship through a Croatian parent .

The timing and conditions of that citizenship application depend on its own legal basis. They should not be inferred simply from the duration of an Article 79a residence permit.

How should you prepare your move?

01
Check the relevant status

Review existing citizenship, the emigrant connection and each family member’s possible residence basis.

02
Prepare the certificate evidence

Organise identity, family and supporting records, and clarify the short-stay registration requirement.

03
Coordinate lawful entry and filing

Plan the residence application around entry rules, permitted stay and any document-validity deadlines.

04
Complete the post-approval steps

Address registration, the biometric card, health insurance, work formalities and future renewal dates.

Frequently asked questions

Can I apply if I have never lived in Croatia?

Potentially. The route includes descendants, not only people personally returning to a former home. You must still establish the relevant category and obtain the supporting certificate.

Do I need a Croatian job offer?

This residence purpose is not based on an employer-sponsored work contract. The relevant diaspora basis and remaining residence conditions must instead be established. Work rights under Article 79a follow residence approval.

Can my non-Croatian spouse qualify?

Potentially, through the family-member category. The relationship, Ministry certificate and individual residence application need to be addressed; your approval alone does not issue a permit to your spouse.

Does the certificate let me stay after my visitor allowance expires?

Not by itself. The certificate procedure and the residence application are separate. Any right to remain while the residence case is pending depends on satisfying the applicable filing rules and deadlines.

Is this still called humanitarian residence?

Article 79a establishes a specific immigration-and-return purpose. Older guidance may describe the previous humanitarian route. Earlier qualifying periods can be relevant, but a new application should use the current category and documentation.

Will I automatically become a citizen after three years?

No. The three-year route discussed here concerns possible permanent residence. Croatian citizenship requires a separate legal basis and procedure.
